    You are not legally required to provide us with Personal Information. However, certain Personal Information (as defined below), particularly Medical Information (as defined below), is essential for providing medical consultations, treatment assessments, and prescription from licensed physicians. If you do not provide this required Personal Information, particularly Medical Information, you will not be able to access or use certain features of the Services.

    By accessing or using the Services, you acknowledge that your Personal Information will be collected and processed in accordance with this Privacy Policy, including for the purposes described herein and, where applicable, shared with third parties involved in providing the Services, such as licensed physicians, pharmacies, payment processors, delivery providers, and data hosting providers, including through transfers outside Israel where adequate protection measures are in place as described in Section 7.

    Where required by applicable law, we will obtain your specific and explicit consent before processing certain types of Personal Information, including sensitive health-related data, or before sending you marketing communications. You may withdraw your consent at any time, by contacting us through the methods specified in Section 12, without affecting the lawfulness of any processing carried out prior to such withdrawal, though withdrawal may limit our ability to provide certain Services.

    If you do not agree to this Privacy Policy or to the processing of your Personal Information as described herein, you should not access or use the Services.

    The Services are intended exclusively for male individuals seeking medical treatment for male pattern hair loss. Accordingly, all personal information governed by this Policy shall be treated as relating to individuals in their capacity as prospective patients, patients, and recipients of healthcare services.

    Any capitalized but undefined term in this Policy shall have the meaning given to it in our Terms of Service ("Terms").

    1. Personal Information We Collect

    When we use the terms "Personal Data" or "Personal Information" in this Privacy Policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or anonymized information that is maintained in a form that is not reasonably capable of being associated with or linked to an individual.

    When you use or access the Services, we collect certain categories of information about you from a variety of sources, as described below.

    1.1. Information you provide us

    The Services require you to provide us with certain information about yourself. You may elect not to provide this information, but doing so will prevent you from accessing the Services. Information that you directly submit through our Services includes:

    1.1.1. User Information. When you use the Services, we collect certain information about you ("User Information"), including your full name, Israeli I.D. number, gender, birth date, address, email address, telephone number, and any optional information you choose to add. If you have any questions or believe your User Information has been compromised, please contact us immediately at privacy@geverhealth.com.

    1.1.2. Hair Loss Medical Questionnaire. To enable licensed physicians to provide you with medical treatment services, we collect sensitive medical and health information through a detailed questionnaire including: (a) medical conditions and medical history; (b) current medications and medication allergies; (c) current health conditions (including, where applicable, prostate cancer, breast cancer, liver disease, kidney disease, diabetes, low blood pressure, mood disorders, or confirmation that none of these apply); (d) information about your hair loss condition, including affected areas (hairline/front, crown/back, front and back, sides, or all over), duration of hair loss, and extent of hair loss; (e) information regarding possible suspected causes of hair loss (for example, hereditary/genetics, stress, medications, medical condition, other, or unknown); (f) whether you have been evaluated by a physician for hair loss; (g) scalp-related symptoms and conditions, including scalp problems and excessive dandruff; (h) whether you are losing hair in other body areas; and (i) whether you have tried hair loss treatments before (collectively, "Medical Information" or "Medical Data").

    This Medical Information is collected to enable licensed physicians to review your condition and determine whether to issue a prescription for treatment.

    1.1.3. Communication Information. If you communicate with us, such as via email or our pages on social media sites, we may collect Personal Data like your name, contact information, and the contents of the messages you send ("Communication Information").

    1.1.4. Payment Information. We collect payment information, such as credit or debit card details and billing addresses, through third-party payment processors (such as Stripe or other payment processing providers we may engage from time to timeder) ("Payment Information"). We use this information as necessary to fulfill our contract with you, process your payments, and provide the Services.

    1.1.5. Service Interaction Information. Your input and output, such as questions, responses to our hair loss medical questionnaire, and other content that you input, upload or submit to the Services, and any information exchanged in connection with physician consultations ("Service Interaction Information"). This content may constitute or contain Personal Information, including Medical Data, depending on the substance. We use this information where necessary to perform our contract with you to enable licensed physicians to assess your condition and facilitate medical review and treatment services.

    1.1.6. Other Information You Provide. Any other information you choose to include in communications with us that is reasonably necessary to fulfill our contractual obligations, for example, when sending a message through the Services or providing feedback about our Services.

    1.2. Information we collect automatically

    Through your interaction with our Services, we automatically collect (including through the use of analytics and system monitoring tools) certain information that may include the following ("Usage Data"):

    1.2.1. Log Data: We collect information that your browser or device automatically sends when you use our Services. Log data includes your internet protocol address, browser type and settings, the date and time of your request, and how you interact with our Services.

    1.2.2. Location Information: We may determine the general area from which your device accesses our Services based on information like its IP address to: (i) enhance security by detecting unusual activity and potential unauthorized access; (ii) comply with applicable laws and regulations; and (iii) improve service functionality and user experience.

    1.2.3. Device Information: We collect information about the device you use to access the Services, such as the name of the device, device identifiers, and browser you are using.

    1.2.4. Usage Data: We collect information about your use of the Services, including the content you view or interact with, features you use, actions taken.

    1.2.5. Cookies and Similar Technologies: We use cookies and similar technologies to operate and administer our Services and improve your experience. For more information on how we use Tracking Technologies and your choices, see the Section 6 below ("Cookies and Other Tracking Technologies").

    Depending on the context and applicable law, certain Usage Data may constitute Personal Information if it identifies you or can reasonably be linked, directly or indirectly, to you.

    1.3. Information we collect from other sources

    We may receive information about you from third parties in certain circumstances, including where such third parties assist us in providing, operating, securing, and improving our Services, as further detailed below.

    1.3.1. Security and Fraud Prevention Providers: We may obtain information from third-party security service providers to protect our Services against fraud, abuse, and other security risks. Such information may include: IP addresses, device identifiers, usage patterns, risk or fraud indicators, and information of a similar nature.

    1.3.2. Marketing Vendors: We may receive information from marketing vendors such as GR Marketing and other similar third parties who are marketing vendors, that assist us in identifying or qualifying potential customers for our Services. Such information may include: contact details (including name, email address, phone number, and other similar information), demographic data, and information regarding your interest in our Services.

    1.3.3. Licensed Physicians: We may receive information from licensed physicians who review your Medical Information and provide treatment recommendations. Such information may include: medical assessments, treatment recommendations, prescriptions, related health information, and other information of a similar nature.

    1.3.4. Pharmacies and Delivery Providers: We may receive information from Partner Pharmacies and delivery service providers in connection with the fulfillment and delivery of your prescriptions. Such information may include: prescription details, order status, shipment tracking information, delivery confirmation and other information of a similar nature.

    2. How We Use Collected Information and Lawful Basis for Processing

    Subject to applicable laws, including the Protection of Privacy Law, 1981 and its regulations, we will use your Personal Information as necessary to provide our Services and develop it ; to comply with our legal and contractual obligations; to support our legitimate interests, such as maintaining and improving our Services, promoting our Services, developing marketing strategies, protecting and securing our customers, ourselves and our Services from misuse and law violations; and where required by law, based on your consent.

    2.1. Purposes of Use of Personal Information

    We process your Personal Information (including User Information, Communication Information, Payment Information, Service Interaction Information, Usage Data (as applicable), and other non-medical information) for the following purposes:

    • To facilitate, operate, provide, and maintain our Services – Including service delivery and platform functionality.
    • To communicate with you – Including transactional communications such as prescription confirmations, delivery updates, account notifications, service announcements, and responses to your inquiries.
    • To process payments and manage billing – Including payment processing, invoice generation, billing management, and financial record-keeping.
    • To improve and develop our Services – Including conducting analytics, analyzing user behavior and preferences, testing new features, enhancing user experience, and developing new services.
    • To prevent, investigate, and respond to fraud, unauthorized access, security threats, and policy violations – Including detecting and preventing fraudulent transactions, protecting against unauthorized access, investigating security incidents, and enforcing our Terms.
    • To enforce our Terms and other contractual arrangements – Including taking action in legal disputes, complying with legal process (such as court orders and subpoenas), and protecting our legal rights.
    • To comply with legal obligations – Including complying with applicable laws and regulations, responding to requests from regulatory authorities, and fulfilling reporting requirements.
    • To protect rights, privacy, safety, and property – Including protecting the rights, safety, and property of GEVER, our users, and third parties.
    • To create aggregated statistical data and anonymized data – Including generating anonymized or pseudonymized data for research, analytics, service improvement, and other purposes where the data cannot be linked back to you.

    2.2. Purposes of Use of Medical Information

    We use your Medical Information solely for the following purposes:

    • Medical Review and Treatment Determination – To enable licensed physicians to review your condition, assess your suitability for treatment, and determine whether to issue a prescription;
    • Prescription Issuance – To facilitate the issuance of prescriptions by licensed physicians (if your treatment is approved);
    • Prescription Fulfillment – To coordinate with Partner Pharmacies for the preparation and dispensing of your prescribed medications;
    • Delivery Coordination – To arrange delivery of your prescribed medications through our delivery service providers;
    • Customer Support – To provide ongoing customer support related to your treatment, respond to your inquiries, and address any concerns;
    • Service Improvement and Development – To analyze treatment outcomes (in anonymized or aggregated form where possible), improve our Services, and develop better treatment pathways and patient experiences;
    • Legal and Regulatory Compliance – To comply with legal and regulatory obligations applicable to healthcare services, including reporting requirements, pharmacovigilance, and regulatory audits; and
    • Safety and Security – To protect the safety and security of our Services, prevent fraud and abuse, and ensure the integrity of our platform.

    2.3. Marketing Communications

    We may use your contact information (such as your name, email address, and phone number) to send you marketing communications, including:

    • Newsletters and updates about our Services;
    • Promotional materials and special offers;
    • Information about new treatments, features, or services that may be of interest to you; and
    • Educational content related to hair loss treatment and men's health.

    Such communications will be sent to you only where you have provided your explicit consent, including in accordance with the Israeli Communications Law (Telecommunications and Broadcasting), 1982.

    We do not use your Medical Information for marketing purposes. Marketing communications are based solely on non-medical information.

    You may opt out of receiving marketing communications at any time by:

    • Clicking the "unsubscribe" link included in any marketing message;
    • Replying to the message with a removal request (where applicable); or
    • Contacting us at privacy@geverhealth.com.

    We will process your opt-out request within a reasonable time and no later than seven (7) business days from receipt of your request.

    3. Disclosure of Personal Information

    3.1. Service Providers: We may engage selected third parties to perform services complementary to our Services. Such service providers may include secure cloud hosting and storage services provided through Google Cloud and hosted in the United States, server co-location services, communications and content delivery networks (CDNs), data security services, fraud detection and prevention services, analytics services, e-mail distribution and monitoring services, payment processors, customer support systems, and our legal, financial and compliance advisors (collectively, "Service Providers"). Our Service Providers may have access to Personal Information, depending on each of their specific roles and purposes in facilitating and enhancing the Services, and may only use the information for such limited purposes and commit to protect your privacy as determined in our agreements with them.

    All third-party service providers processing Personal Data on our behalf are bound by data processing agreements that align with Israeli privacy law requirements and international standards where applicable. These agreements ensure that your Personal Data is processed securely and only for the intended purposes.

    3.2. Licensed Physicians: We share your Medical Information with licensed physicians who review your condition and determine whether to issue a prescription for treatment. These physicians are independent healthcare professionals who are licensed to practice medicine in Israel. The physicians are bound by professional confidentiality obligations and medical ethics rules. Each physician acts independently in forming a physician-patient relationship directly with you. GEVER serves solely as a technology platform facilitating this relationship and does not provide medical advice, treatment, or medical services. GEVER is not responsible for any medical decisions, treatment outcomes, or professional conduct of the independent physicians.

    3.3. Partner Pharmacies: If a physician approves your treatment and issues a prescription, we share necessary information (including your name, contact information, prescription details, and delivery address) with our partner pharmacies to fulfill your prescription. Our partner pharmacies Harokhim, E.L Medi-Market Ltd. (the "Partner Pharmacies") are licensed pharmaceutical providers bound by confidentiality obligations under Israeli law and pharmacy regulations.

    3.4. Delivery Providers: We share necessary information, including your name, delivery address, and contact information, with Partner Pharmacies that facilitate the delivery of prescribed medications and employ licensed delivery drivers for such deliveries. The Partner Pharmacies and delivery personnel do not have access to detailed medical information beyond what is necessary for delivery purposes.

    3.5. Cloud Service Providers: Your Personal Information, including Medical Data, is stored on cloud infrastructure provided by Google Cloud and hosted in the United States. This provider are bound by strict data processing agreements and security obligations.

    3.6. Advertising Partners: We may disclose non-medical information (such as contact information and Usage Data) to third-party advertising partners (such as Meta, Google, TikTok, and other similar providers(, in order to market and promote our Services' user base, including through advertising, targeted marketing, and remarketing activities carried out on those platforms. Please see the "Your Choices" and "Data Subject Rights" sections below for additional information.

    3.7. Legal Compliance: We may disclose or allow government and law enforcement officials access to your Personal Information, in response to a subpoena, search warrant or court order (or similar requirement), or in compliance with applicable laws and regulations, including the Protection of Privacy Law, 1981 and regulations issued thereunder. Such disclosure or access may occur if we believe in good faith that: (a) we are legally compelled to do so; (b) disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing; or (c) such disclosure is required to protect the security or integrity of our Services.

    3.8. Protecting Rights and Safety: We may share your Personal Information if we believe in good faith that this will help protect the rights, property or safety of our Company, any of our users, or any members of the general public.

    3.9. Merger, sale, or other structural change: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of some or all assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

    3.10. Professional Advisors: As necessary, we will share your Personal Data with professional advisors such as auditors, law firms, or accounting firms.

    4. Retaining Personal Information

    We will retain your Personal Data for only as long as necessary to provide our Services to you or fulfill the purposes for which it was collected. This includes legitimate business purposes, such as resolving disputes, ensuring safety and security, complying with legal obligations, or protecting our rights, preventing harm, promoting safety, security and integrity or to have proof and evidence concerning our relationship in case of legal issues following the termination of Services.

    Medical Information will be retained in accordance with Israeli healthcare regulations, which may require retention of medical records for a minimum period. Even after you cease using our Services, we may be legally required to retain your medical information for this statutory period.

    When determining the length of time to retain your information, we consider various criteria, including the following factors:

    • our purpose for processing the data (e.g., whether it is required to continue providing our Services);
    • the amount, nature, and sensitivity of the information;
    • the potential risk of harm from unauthorized use or disclosure;
    • any applicable legal or contractual requirements, including healthcare and pharmaceutical regulations; and
    • medical record retention requirements under Israeli law.

    If the retention purpose has been fulfilled and the statutory retention period has expired, we will securely delete, restrict access to, or de-identify your Personal Information. If deletion is not possible due to legal or technical constraints, we will ensure that your Personal Data is securely archived and access is restricted.

    Except as required by applicable law or specific agreements with you, we are not obligated to retain your Personal Information for any particular period beyond statutory requirements and may securely delete, restrict access to, or de-identify it at our sole discretion once legal obligations are satisfied.

    5. Transfer of Personal Information

    We may transfer, store, and process your Personal Information in Israel and in other jurisdictions, as necessary for the provision of our Services, including by using affiliated entities and third-party service providers (as described in this Privacy Policy), which may be located outside of Israel. Such third parties may further transfer the information to their own service providers.

    Please note that some jurisdictions may not provide the same level of data protection as Israel. However, we take appropriate measures to ensure that your Personal Information remains protected in accordance with applicable law and this Privacy Policy, including by implementing contractual safeguards and requiring our service providers to maintain adequate data protection and security standards.

    By using the Services, you acknowledge and agree that your Personal Information may be transferred outside of Israel.

    We use Cookies and similar technologies (such as pixels, web beacons, local storage, and session storage) to operate and secure the Website, improve performance, prevent fraud, personalize content, perform analytics, and comply with legal requirements. When you visit the Website, we and our service providers may automatically collect technical and usage information, such as your IP address, device type, browser, operating system, screen resolution, language, access times, pages visited, clicks, and, where allowed, approximate location. Some cookies are temporary ("Session Cookies") and are deleted when you close your browser. Others are persistent ("Persistent Cookies") and remain for longer periods.

    To the fullest extent permitted by applicable law, we disclaim liability for unauthorized disclosure or access to your Personal Information resulting from circumstances beyond our reasonable control.

    8. Your Choices and Data Subject Rights

    Under the Protection of Privacy Law, 1981 and its regulations, you have certain rights regarding your Personal Information that you have provided to us and that is maintained in our databases, including the rights described below.

    Please note: Certain Personal Information may be exempt from rights of access, correction, or deletion under applicable laws, including medical record retention requirements under Israeli healthcare regulations, ongoing legal proceedings, fraud prevention investigations, regulatory compliance obligations, and statutory retention periods for tax and insurance purposes.

    9. Children's Privacy

    Our Services are intended for adults aged 18 and over. We do not knowingly collect, use, or store Personal Information from individuals under the age of 18.

    Given that our Services involve the provision of medical treatment, we only provide Services to individuals who are legally capable of consenting to medical treatment under Israeli law. If you are under 18 years of age, you may not use our Services .

    If we become aware that we have inadvertently collected Personal Information from an individual under 18 without proper consent, we will take immediate steps to delete such information from our records.

    If you believe that we might have inadvertently collected Personal Information from someone under the age of 18, please contact us immediately at privacy@geverhealth.com.

    10. Updates and Amendments

    We may modify this Privacy Policy from time to time, in which case we will update the "Last Updated" date at the top of this Privacy Policy. If we make material changes to the way in which we use or disclose information we collect, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us, by posting notice of such changes on the Services, or by other means consistent with applicable law) and will take additional steps as required by applicable law. If you do not agree with any updates to this Privacy Policy, please do not continue using or accessing the Services.

    11. Governing Law.

    This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of laws rules. The Parties irrevocably consent to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel, to adjudicate all disputes arising from or related to This Privacy Policy to the exclusion of the jurisdiction of any other court.
